The article examines the legal status of living wills and health care proxies in Germany, the United States and Japan. The investigation begins with the question of what protection these three legal orders provide for the right to self-determination. Whereas in Germany and the United States, legislation and legal practice take the theory of informed consent very seriously, the doctor-patient relationship in Japan is much less oriented toward the idea of patient autonomy. This basic attitude is reflected in the legal (...) disposition given advance directives. In the USA, most of the individual states have legislation on the living will and health care proxies. In Germany, the judiciary and scholarly literature at least carefully affirm that they are legally binding. In Japan, at least currently, there is nothing at all similar to this approach. The authors then conduct a micro-legal comparison of cases of first impression decided in the USA and Germany and emphasize the amazing similarity of the judicial decisions in two cases . Finally, the question is raised for German law of whether, and in what form, further legislative development of the judicially established right to die appears reasonable. Der vorliegende Beitrag untersucht den rechtlichen Stellenwert von living wills und health care proxies in Deutschland, in den USA und in Japan. Ausgangspunkt der Untersuchung ist die Frage, welchen Schutz das Selbstbestimmungsrecht in den erwähnten Rechtsordnungen genießt. Während in Deutschland und in den USA Gesetzgebung und Rechtspraxis die Theorie vom informed consent sehr ernst nehmen, ist das Arzt-Patienten-Verhältnis in Japan weit weniger vom Gedanken der Autonomie des Patienten bestimmt. Diese Basiswertung schlägt auch im Bereich der rechtlichen Beurteilung von advance directives durch. In den USA sind living will und health care proxy in den meisten Einzelstaaten gesetzlich geregelt, in Deutschland wird ihre rechtliche Verbindlichkeit von Judikatur und Literatur zumindest vorsichtig bejaht. In Japan fehlen - zumindest derzeit - entsprechende Ansätze noch gänzlich.Die Verfasser stellen sodann einen Mikrorechtsvergleich zwischen den in den USA und in Deutschland entschiedenen cases of first impression an und betonen den erstaunlichen Gleichklang der rechtlichen Beurteilung dieser beiden Fälle .Schließlich wird für deutsches Recht die Frage gestellt, ob - und in welcher Form - eine legislative Weiterentwicklung des judiziell bereits etablierten right to die angemessen erschiene. This book presents an innovative reading of Daoist philosophy that highlights the critical and therapeutic functions of satire and humor. Moeller and D'Ambrosio show how the Zhuangzi expounds the Daoist art of "genuine pretending" the paradoxical skill of enacting social roles without submitting to them or letting them define one's identity.

Justice, equality, and righteousness—these are some of our greatest moral convictions. Yet in times of social conflict, morals can become rigid, making religious war, ethnic cleansing, and political purges possible. Morality, therefore, can be viewed as pathology-a rhetorical, psychological, and social tool that is used and abused as a weapon. An expert on Eastern philosophies and social systems theory, Hans-Georg Moeller questions the perceived goodness of morality and those who claim morality is inherently positive. Critiquing the ethical "fanaticism" (...) of Western moralists, such as Immanuel Kant, Lawrence Kohlberg, John Rawls, and the utilitarians, Moeller points to the absurd fundamentalisms and impracticable prescriptions arising from definitions of good. Instead he advances a theory of "moral foolishness," or moral asceticism, extracted from the "amoral" philosophers of East Asia and such thinkers as Ludwig Wittgenstein and Niklas Luhmann. The moral fool doesn't understand why ethics are necessarily good, and he isn't convinced that the moral perspective is always positive. In this way he is like most people, and Moeller defends this foolishness against ethical pathologies that support the death penalty, just wars, and even Jerry Springer's crude moral theater. Comparing and contrasting the religious philosophies of Christianity, Daoism, and Zen Buddhism, Moeller presents a persuasive argument in favor of amorality. (shrink)

Die Begriffe 'Pluralismus', 'Wahrheit' und 'Toleranz' werden sowohl deskriptiv im Sinne einer Zustandsbeschreibung als auch normativ im Sinne eines wünschenswerten Verhaltens gebraucht und verweisen auf gesellschaftliche Spannungen in pluralistischen Gesellschaften. In liberal-demokratischen Gesellschaften gewährleistet die weltanschauliche Neutralität des Staates die Koexistenz von Lebensformen unterschiedlicher kultureller Prägung mit divergierenden Vorstellungen von einem guten Leben und von der wahren Weltordnung. Guo Xiang's (252-312) reading of the famous "Butterfly Dream" passage from the Zhuangzi differs significantly from modern readings, particularly those that follow the Giles translation. Guo Xiang's view is based on the assumption that the character of Zhuang Zhou has no recollection of his dream after awakening and therefore does not entertain doubts about what or who he really is. This leads to a specific understanding of the allegorical and philosophical meaning of the text that stands in contradistinction to most (...) modern interpretations. In these essays, Gadamer justifies the reasons for a philosophical interest in health and medicine, and a corresponding need for health practitioners to enter into a dialogue with philosophy.

The narrative of the Death of Emperor Hundun 混沌, who finally perishes from the seventh hole that his two fellow Emperors have drilled into his formless body to do him the favor of supplying him with a face, famously concludes the seven Inner Chapters of the Zhuangzi 莊子.1 Perhaps the sudden demise of the story’s protagonist is meant to signal paradoxically to the reader that he or she, too, has, unwittingly, now come to an end and reached a stage of (...) no return. With the completion of the seventh chapter, seven deep holes have been drilled into one’s head and have transformed one irredeemably. “Marx na Universidade!” Esta palavra de ordem sinalizou as reivindicações do Movimento Estudantil, que agitou as universidades alemãs há mais do que cinco décadas, refletindo sobre a missão político-social da formação universitária. O fato de, naquele tempo, a indicação de uma aula sobre a teoria de Karl Marx ter sido sacrificada pela censura dos órgãos políticos da universidade tornou-se incompreensível em nossos dias.[1] Pelo contrário, depois da preocupação intensa com a teoria marxiana nas décadas passadas, o interesse nela parece ter (...) diminuído rapidamente. Acho que foram sobretudo duas razões que levaram a esse processo. Em primeiro lugar, a crítica da economia política foi aceita como teoria científica, tendo enfraquecido assim seu potencial crítico em relação ao desenvolvimento real das sociedades cunhadas pelo capitalismo tardio. Ela tornou-se apenas uma base entre outras na compreensão científica da realidade social.[2] Além disso, a teoria, ela mesma, contém traços objetivistas ao apresentar a análise das estruturas materiais e econômicas, fazendo desaparecer o sujeito humano — fato este, que levou a teoria a aproximar-se aparentemente aos dogmas positivistas da moderna ciência. A teoria de Marx correria, por isso, o risco de mover-se na vizinhança do positivismo científico sacrificando seu impulso emancipatório. Como pôde essa perversão surgir na recepção dessa teoria? Por que esta teoria tão ambiciosa perdeu seu potencial político, deixando-se incluir no pluralismo das teorias científicas? Achando que a teoria de Marx em si mesma não foi inocente quanto a esse processo ou, ao menos, a esse risco, não quero dizer que tivesse refletido de modo insuficiente sobre a emancipação humana. Muito pelo contrário, provarei que a história de sua recepção, assim como a construção teórica da crítica da economia política dão razões significativas para obrigar seu autor a destematizar os sujeitos humanos e, por isso mesmo, chamar a atenção a esse sujeito desaparecido. Em dois passos, explicarei a seguir as razões fundamentadoras dessa tese à primeira vista paradoxal. Na primeira parte da argumentação examinarei o desenvolvimento da teoria de Marx, que se lê como processo de abandono do discurso sobre o sujeito humano, ao passo que na segunda localizarei o destino dos sujeitos e da perspectiva emancipatória, provocados pelas razões internas dessa teoria. Finalmente, incluirei alguns pontos caraterísticos de uma subjetividade humana não dominada pela alienação vigente nas nossas sociedades capitalistas, extraindo assim uma perspectiva produtiva da argumentação anterior. In this paper, the descriptive information contained in empirical laws is contrasted with common-sense descriptions of situations and behavior. According to the Hempel-Oppenheim-Schema, explanation is, essentially, conceived as a matter of deductive reasoning in which the fact to be explained is subsumed under one (or more) empirically valid generalizations or laws. However, this kind of explanation is necessarily based on intuitive processes of diagnosis and interpretation. It is argued that these intuitive processes enable the scientist to formulate descriptive sentences which (...) form the arguments of logically correct explanations. It is assumed that people produce common-sense descriptions of situation and behavior in correspondence with their subjective experience of other people's behavior and its determinants. In order to obtain intuitively adequate empirical generalizations and behavioral laws it is proposed that common-sense descriptions of behavior and situations should be integrated into the antecedent and/or consequent of laws. In such a research strategy the regularities between meaningfully interpreted situational and behavioral aspects can be studied. (shrink)
